Controller and definitions
Patient: any adult using the Dietitian’s services and any minor using them with the written consent of a legal guardian.
Dietitian: the service provider and data controller Monika Chojnacka, conducting business as 23 Monika Chojnacka, ul. Niemczańska 33/6, 50-561 Wrocław, Poland, Tax Identification Number (NIP): 7692204980.
Data privacy
The Patient gives voluntary and informed consent to the Dietitian processing their personal data, including special-category health data provided during online sessions, in email correspondence and through electronic forms.
Personal data is processed for:
- providing dietetic and psychodietetic sessions
- communicating with the Patient
- maintaining records connected with the provision of services
- scientific and statistical purposes, solely in anonymised form that prevents identification of the Patient.
The legal bases for processing personal data, including health data, are:
- Article 6(1)(b) GDPR - performance of a contract
- Article 6(1)(a) GDPR - the Patient’s consent
- Article 9(2)(a) GDPR - explicit consent to the processing of special-category data.
Personal data may be processed using information technology tools that enable the Dietitian to provide services, in particular tools provided by Google LLC, on the basis of appropriate legal and technical safeguards required by the GDPR.
Personal data will not be transferred to other entities or made available to third parties, except in cases of:
- the Patient’s written consent (for example, interdisciplinary sessions)
- an obligation arising from the law.
The Patient’s personal data will be stored:
- until consent is withdrawn, for no less than six years
- after six years, the data will be permanently deleted or anonymised.
The Patient has the right to access, rectify and erase their data, restrict its processing, transfer data, withdraw consent at any time and lodge a complaint with the President of the Personal Data Protection Office.
